Licensing Terms and Liability

The licensing terms given below apply to On Time RTOS-32 licenses acquired according to On Time's published price lists. Other terms may be available at different prices. If you need to license On Time RTOS-32 with different terms, please contact On Time for details.

Definitions

The On Time RTOS-32 software product consists of components RTTarget-32, RTKernel-32, RTFiles-32, RTUSB-32, RTPEG-32, and RTIP-32 (programs, libraries, object code, source code, and documentation). RTTarget-32, RTKernel-32, RTFiles-32, and RTUSB-32 are the proprietary property of On Time Informatik GmbH, Hamburg, Germany (On Time). RTPEG-32 and RTIP-32 have been licensed by On Time from Swell Software Inc. and EBSnet Inc., respectively. The SMB3 Server and Client have been licensed by On Time from Visuality Systems Ltd. The following licensing terms apply to any set of one or more On Time RTOS-32 components licensed as given on the License Certificate.

Grant of License

On Time RTOS-32 is licensed to software developers. Each developer who creates software which is invoked (directly or indirectly) through On Time RTOS-32 or may cause (directly or indirectly) On Time RTOS-32 code to be executed needs an On Time RTOS-32 license. Applications developed in accordance with these terms are free of run-time royalty and may be duplicated and distributed in any quantity with no obligation to pay any additional fees to On Time.

By purchasing an On Time RTOS-32 license, the licensee acquires the right to develop and distribute application programs linked with libraries, object code, or boot code delivered with On Time RTOS-32 under the following conditions:

• The application does not contain files delivered with On Time RTOS-32 other than linked into the application, with the exception of the files enumerated in section Redistributable Components of RTTarget-32 in this manual.
• The application is not a software development product, library, operating system, interpreter, or program loader which could execute software (executable code, interpreted programs, scripts, virtual machine code, etc) not provided by the licensee.
• The application is shipped as a binary image only. It must not be shipped as a statically or dynamically linkable file (as, for example, .obj files, .lib files, .dll files, .exe files, Win32 PE files, etc). Examples of acceptable binary images are .rtb files (RTTarget-32 binaries), .rta files (RTTarget-32 disk boot images), .bin files (binary image files), .hex files (Intel HEX file format), .dlm files (RTTarget-32 dynamically loadable modules), or such images stored in non-volatile memory such as ROM, EPROM, EEPROM, or Flash.

If an On Time RTOS-32 license includes source code components, such source code (modified or not), and any executable files, object files, or library files created from it may only be used by On Time RTOS-32 licensees working under the same On Time RTOS-32 license.

License Certificate

Proof of a legitimate license is a unique On Time RTOS-32 License Certificate issued by On Time. The On Time RTOS-32 License Certificate bears On Time's company logo and lists all licensed License Numbers, Installation Keys, and License Keys. License Serial Numbers are printed on adhesive labels each of which also bears On Time's colored company logo. The License Certificate states which On Time RTOS-32 components have been licensed for how many software developers of a team.

Team Licenses

An On Time RTOS-32 Team License may at any one time be used by only one team. Single developers may leave and join the team as long as the total number of team members stated on the License Certificate is not exceeded. The On Time RTOS-32 License Certificate states the maximum number of team members and computers the software may be used by/on simultaneously. The On Time RTOS-32 License Certificate contains a unique License Key for each team member.

A team license may be transferred to another team if this team accepts these licensing terms. When a license is transferred to another team, the complete product contents including the License Certificate must be given to the new licensee; copies of On Time RTOS-32 materials must be permanently destroyed.

Liability

This software and documentation is sold "as is" without warranty as to their performance, merchantability, or fitness for any particular purpose. The entire risk as to the quality and performance of the software is assumed by the licensee. On Time warrants that the CD-ROM or diskettes on which the software is furnished will be free from defects in materials and workmanship under normal usage for a period of ninety days from the date of original purchase. The licensee's sole and exclusive remedy in the event of a defect is expressly limited to the replacement of the CD-ROM or diskettes.

In no event shall On Time or anyone else who has been involved in the creation, production, or delivery of this software be liable for any direct, incidental or consequential damages, such as, but not limited to, loss of anticipated profits, benefits, use, or data resulting from the use of this software, or arising out of any breach of any warranty.
